THE LIABILIZATION OF PUBLIC AGENTS REGARDING THE NON-COMPLIANCE WITH STANDARDS FOR THE IMPLEMENTATION OF URBAN DIRECTIVES AFTER LAW No. 14,230/21

This study analyzes the current Brazilian legislation concerning the requirements for a more efficient and effective urban planning. Firstly, based on the vast consolidated doctrine, we evidence how public agents are held accountable within the scope of the State's civil responsibility. We seek to demonstrate the changes in the Law of Administrative Improbity
(LIA) since the enactment of Law No. 14,230/21, especially with regard to the liability of public
agents who fail to observe the existing legal provisions for the consolidation of urban public
policies. Moreover, we highlight the relevance of establishing dialogue between society as a whole and the public authorities so that the urban directives can be put into effect in the best possible manner and extent. Lastly, from an analysis of doctrine, legislation, and jurisprudence, we demonstrate how significant are the legislative changes that have been enacted, to the point
of compromising rights and guarantees that have already been secured.
